** - Commingled recycling is when the homeowner can mix all of the recycling materials together. This has a higher discard rate on the other end.
*** - Automated collection is with the collection arm. Only one person per route is required.
The challenge facing Roy's is not too different from the Department of Justice (DoJ) consent decree signed by Waste Management in February 1996. DoJ's antitrust division charged WMX with barring competition illegally by requiring three year contracts automatically renewed for three years. Any customer wanting to cancel their contract except at its end paid a six time monthly charge as a liquidation fee! WMI agreed to limit contracts to two years and liquidation fees to three times in the consent decree which covered Central Louisiana and Savannah, Georgia.
WMI said it would continue its three year contracts in other parts of the country, claiming them to be standard contracts. In Roy's area WMI contracts may make it very difficult for Roy's to regain contracts lost to WMX through its predatory pricing program.
